Bryan J Heaney

Bryan Heaney is an experienced advocate who provides clear, comprehensible and practical advice in a broad range of subject areas. As can be seen from the list of recent cases he maintains a general practice.

Bryan has a special interest in civil and criminal proceedings under the Proceeds of Crime Act 2002. He is the Scottish reporter for Lloyd’s Law Reports, Financial Crime. Bryan’s other special interest is in Employment Law. He has conducted long and complex tribunal cases, including discrimination cases, for both claimants and respondents.

In 2005 he was appointed Standing Junior Counsel to the Scottish Ministers and has appeared on their behalf in various courts and tribunals including the Lands Tribunal and Land Court.In 2010 Bryan was appointed a Legal Assessor to the Disciplinary Sub-Committee of the General Teaching Council for Scotland. As such he provides legal advice to the committee that decides on complaints of professional misconduct against teachers.

Bryan keeps his legal knowledge up to date in his capacity as Scottish reporter for the Times Law Reports and as editor of the Court of Session Cases and Comment section of Green’s Civil Practice Bulletin.

  • Stewart v Malik, 2009 SC 265 – appeal to the Inner House on the hazardous operations exception to the rule that independent contractors are liable for their own wrongs.

 

  • Cultural and Educational Development Association of Scotland v Glasgow City Council, 2008 SC 439appeal to the Inner House in relation to legal personality and title to sue in a discrimination case.

 

  • Scottish Ministers v Stirton, 2008 SLT 505 – appeared for the Scottish Ministers in the leading Scottish case on Interim Administration Orders under POCA.

 

  • Hughes v Grampian Country Foods Group Ltd, 2007 SLT 635 - appeal to the Inner House on the interpretation of the Manual Handling Operations Regulations 1992.

 

  • T Millar & Sons v Scottish Ministers, 2006 SLCR (2) 200 - an appeal to the Scottish Land Court in relation to the interpretation of the European Regulations governing the Suckler Cow Premium Scheme.
